By accessing or using the Site you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms you must not access or use the Site.
These Terms should be read together with our privacy policy and cookie policy, which together govern how we collect and use your personal data and cookies.

We will try to give reasonable notice of any major changes, but we may suspend, withdraw or restrict the availability of all or any part of the Site for business, security or operational reasons.

A breach of this section may constitute a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law-enforcement authorities and will co-operate with those authorities by disclosing your identity to them. We reserve the right, without notice, to suspend or terminate your access to the Site if we reasonably believe you have breached these Terms.
7. User-submitted content
If you submit content through the Site — for example by completing the contact form — you warrant that you have the right to provide that content, that it is accurate, that it is not misleading, and that it does not infringe the rights of any third party. You retain ownership of any content you submit, but you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, store and reproduce that content solely for the purpose of responding to your enquiry and providing services to you.
You agree not to submit content that is defamatory, obscene, indecent, hateful, discriminatory, threatening, infringing, deceptive, fraudulent, or that contains personal data about any third party without that party's consent.

Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
The Wanstone name, the Wanstone logo, and all related names, logos, product and service names, designs and slogans are trademarks of Wanstone Ltd or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs and slogans on the Site are the trademarks of their respective owners.
You may print off one copy, and may download extracts, of any page(s) from the Site for your personal use or for use by people within your organisation. You may not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of content on the Site must always be acknowledged. You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.
9. No reliance on information
The content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Site.

10. Client engagements
The Site is for information only and does not constitute an offer to contract for services. Any engagement between you and Wanstone for paid services is governed by a separate signed statement of work, order form or master services agreement (a “Services Agreement”), which will set out the specific commercial terms, deliverables, fees, payment schedule, intellectual property assignment, liability cap and other obligations of each party.
In the event of any conflict between these Terms and a signed Services Agreement, the Services Agreement shall prevail in respect of the engagement to which it relates.
11. Links to and from the Site
The Site may contain links to other sites and resources provided by third parties. These links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to the Site in any website that is not owned by you. The Site must not be framed on any other site.
12. Disclaimer
The Site and its content are provided “as is” and “as available”. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited under applicable law.
Subject to the paragraph above, to the extent permitted by law, we exclude all liability (whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise) for any loss or damage arising under or in connection with use of, or inability to use, the Site, or use of or reliance on any content displayed on the Site. In particular, we will not be liable for:

- Business interruption
- Loss of anticipated savings

If you are a business user, you accept that the Site is provided to you free of charge for the purpose of information only, and that any commercial reliance is at your own risk.

We do not guarantee that the Site will be secure or free from bugs or viruses. You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.
16. Privacy and cookies
We process personal data in accordance with our privacy policy and use cookies as described in our cookie policy. By using the Site you consent to such processing and you warrant that all data provided by you is accurate.
17. Events outside our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an event outside our reasonable control, including (without limitation) acts of God, war, terrorism, civil commotion, governmental action, fire, flood, epidemic, pandemic, failure of public or private telecommunications networks, or industrial action.
18. Severability
If any provision of these Terms is held by a court or other competent authority to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to make it valid, enforceable and legal.
19. Waiver
No failure or delay by us to exercise any right or remedy under these Terms shall constitute a waiver of that right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy.
20. Third-party rights
A person who is not a party to these Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
21. Governing law and jurisdiction
These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Site.
